Information on restrictions on the use of services pursuant to Art. 14 of Regulation (EU) 2022/2065 of the European Parliament and of the Council can be found on the platform to which your complaint relates and whose content we merely host as an intermediary.

Information on moderation and restriction of user content

Form for reporting illegal content (abuse reports):

Moderation and restriction of user content is carried out on the common basis of content moderation for hosting services and takes into account the statutory model of liability for unlawful third-party content after obtaining knowledge (“notice and take down”) pursuant to Art. 6 (1) DSA (Digital Services Act).

If we receive a report or otherwise become aware of unlawful content, we inform our customer of this and request our customer to remove the content immediately and to submit a statement, or to submit a counter-statement. For this purpose, a form is provided to the customer and a reasonable period, in accordance with statutory provisions, is set. The customer is informed either automatically or manually by a member of our team. After expiry of the set period, the customer receives an automatic reminder if he has not submitted a statement or counter-statement via the form.

III. We reserve the right to block the IP address through which the reported content is accessible after the deadline and after manual review by a member of our team, until the issue has been resolved by the client or a statement or counterstatement has been submitted by the client (legal basis: Art. 6(1) DSA). The client may, at any time, submit an unblocking request via their client account and provide a statement or counterstatement.

We decide on the basis of the information available to us, in accordance with the objective legal situation based on EU and German law. If you are adversely affected by our decision, you have the possibility of an appeal. An appeal may in particular be lodged by direct objection to the decision and must be addressed to “dsa@koch-essen.de” or to our address (see https://koch-essen.de/impressum/). We will promptly, and at the latest within 2 weeks, examine the merits of the appeal and either make a new substantiated decision or provide reasons for rejecting the requested new decision.

V. If, after our review, our assessment remains unchanged and this imposes a legal burden on you, particularly because, for example, content was (not) blocked or a block was (not) maintained, you have recourse to the ordinary courts. For this purpose, you may – subject to other possible avenues such as out-of-court dispute resolution – bring an action before a civil court in an EU Member State. The general statutory limitation periods apply.

To keep our network clean, we also cooperate with various blacklists. If a customer’s IP address is reported via these, an abuse report is sent to the customer as described above. To detect netscans and DDoS attacks, we automatically monitor metadata of transmitted packets to determine whether, due to their nature, they are suitable for enabling communication. If this suitability is lacking, an abuse report is sent to the customer as described above.
